Terms of Service

These Terms explain the rules for using Loot, including our AI analysis, collection tools, accounts, trials, and subscriptions.

Agreement to these Terms

These Terms of Service ("Terms") are an agreement between you and Loot ("Loot," "we," "our," or "us") governing your use of the Loot mobile application, website, and related services (collectively, the "Service").

By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use Loot on behalf of an organization, you represent that you have authority to bind that organization.

Eligibility and accounts

You must be at least 13 years old to use Loot. If the age of digital consent or contractual capacity is higher where you live, you may use Loot only with the involvement and permission of a parent or legal guardian.

Loot may create an anonymous account identifier so you can use core features before registering. You are responsible for safeguarding your device, login credentials, and account activity. Information you provide must be accurate and current. Contact us promptly if you believe your account has been accessed without permission.

License to use Loot

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Loot for lawful personal or internal business purposes.

This license does not transfer ownership of Loot or any part of the Service. Any rights not expressly granted to you are reserved by Loot and its licensors.

Your content

You retain ownership of photographs, descriptions, notes, collection records, and other material you submit to Loot ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, transmit, and process User Content only as reasonably necessary to operate, secure, and provide the Service, including generating requested AI results.

You represent that you have the rights and permissions necessary to submit your User Content and that our processing of it as described in these Terms will not violate another person's rights or applicable law.

Do not upload images containing sensitive documents, private information about other people, unlawful material, or content you do not have permission to use. You are responsible for reviewing the background of a photograph before submitting it.

AI results and valuations

Important:

Loot provides automated visual estimates for informational purposes. It is not a professional authentication, appraisal, provenance, insurance, legal, tax, investment, or financial service.

Identification, origin, date, condition, authenticity indicators, comparable sales, and valuation ranges may be incomplete, outdated, or incorrect. Results can vary based on image quality, available records, market conditions, and limitations of automated systems.

You are responsible for decisions made using Loot. Before buying, selling, insuring, restoring, shipping, donating, or taking legal or financial action involving an object, consult an appropriately qualified independent professional and verify relevant records.

Acceptable use

You agree not to:

  • use Loot for unlawful, fraudulent, deceptive, or harmful activity;
  • upload content that infringes intellectual-property, privacy, publicity, or other rights;
  • attempt to bypass account, scan, subscription, usage, security, or app-integrity controls;
  • probe, disrupt, overload, scrape, or interfere with the Service or its infrastructure;
  • reverse engineer, decompile, copy, resell, sublicense, or commercially exploit the Service except where applicable law expressly permits it;
  • use automated means to access the Service without our written permission;
  • submit malware, harmful code, or material intended to manipulate or abuse AI results; or
  • misrepresent a Loot result as a certified appraisal or guaranteed authentication.

Subscriptions and trials

Loot may offer free and paid features, including trials and automatically renewing subscriptions. The price, billing period, trial length, included features, and renewal terms shown in the App Store or Google Play at the time of purchase form part of these Terms.

Purchases are processed by the platform where you obtained Loot. Subscriptions renew unless canceled through your store account in accordance with that store's terms. Deleting Loot or your Loot account does not automatically cancel a subscription.

You can manage or cancel a subscription through your App Store or Google Play settings. Refund requests are handled under the applicable store's policies unless applicable law requires otherwise. We may change future pricing or plan features with notice required by law or the applicable store; changes will not retroactively alter a completed billing period.

Service availability and changes

We may add, remove, update, limit, or discontinue features, models, categories, usage allowances, or integrations. We may also perform maintenance or experience interruptions. We do not guarantee that every feature, result, or item record will always be available, uninterrupted, secure, or error-free.

Where a material change affects a paid feature, we will provide any notice or remedy required by applicable law and the relevant app store.

Third-party services

Loot depends on third-party services and may link to third-party websites, stores, auction records, authentication providers, payment platforms, and other resources. Their services are governed by their own terms and policies. We are not responsible for third-party content, availability, security, accuracy, or practices.

Apple and Google may impose additional terms that apply to your download, purchase, and use of Loot through their platforms.

Intellectual property

The Service—including its software, interface, design, text, branding, databases, and content supplied by Loot—is owned by Loot or its licensors and protected by intellectual-property laws. These Terms do not grant you permission to use Loot's trademarks, logos, or branding except as necessary to use the Service.

If you send us suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation. This does not give us ownership of photographs or collection content you submit for ordinary use of the Service.

Suspension and termination

You may stop using Loot at any time. We may suspend or terminate access when we reasonably believe you have violated these Terms, created risk for Loot or others, failed to pay applicable fees, abused the Service, or when suspension is required by law.

Where appropriate, we will provide notice and an opportunity to resolve the issue. Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, and general legal provisions—will continue to apply.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Loot disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, and uninterrupted availability.

We do not warrant that AI results, valuations, provenance information, comparable sales, collection records, or third-party data are accurate, complete, current, or suitable for a particular decision. Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Loot and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, or value arising from your use of or inability to use the Service.

Where liability cannot be excluded, our total liability for claims relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply where prohibited by law, including liability that cannot be limited for fraud, willful misconduct, personal injury, or mandatory consumer rights.

General terms

Applicable consumer protections and mandatory local laws continue to apply. Before a formal dispute, you and Loot agree to try to resolve the matter informally by contacting support@lootai.app.

If any provision of these Terms is found unenforceable, it will be modified only to the minimum extent necessary and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, sale, or transfer of the Service.

These Terms, together with the Privacy Policy and any purchase terms presented by the applicable app store, form the entire agreement concerning your use of Loot.

Changes to these Terms

We may update these Terms as Loot, applicable laws, or our business changes. We will publish the revised Terms on this page and update the date above. If a change is material, we will provide additional notice when required. Continuing to use Loot after revised Terms take effect means you accept them.
